These stipulations outline the agreement governing your contract with us, ‘OTR Car Tours Ltd’, Company Registration Number 14842488, setting forth the terms and conditions of your booking. with OTR Car Tours Ltd. This contract is shaped by the parameters laid out in these booking terms and conditions, regulated by English Law, and subject to the jurisdiction of the English Courts.
Every detail provided in our promotional materials, social media channels, or website, is presented with the utmost accuracy based on our knowledge and belief at the time of publication. In case of any alterations that are deemed pivotal to the contract or likely to impact your tour experience, we commit to keeping you informed. Should you have any specific requirements fundamental to your tour, please notify us during the booking process, enabling us to provide you with the most up-to-date information. Within these terms and conditions, “You” and “Your” collectively refer to all individuals listed on the booking, including additions or substitutions made subsequently. “We,” “us,” and “our” pertain to OTR Car Tours Ltd. Unless explicitly stated otherwise, these booking conditions exclusively pertain to the tour arrangements you book with us, which we undertake to organise, deliver, or execute as part of our agreement with you. Any reference in these booking conditions to a “tour,” “booking,” “contract,” or “arrangements” is explicitly directed at such tour arrangements, unless stated otherwise.
BOOKING
To secure your booking, you may: 1) utilise our website for an online booking, or 2) contact our staff by telephone to make a booking. Upon paying the deposit in either of these cases, you are automatically considered to have accepted our booking terms and conditions. For bookings made within eight weeks of departure, full payment is necessary at the time of booking. The person initiating the booking assumes responsibility for all members of the party, especially regarding payment for everyone included in the booking. The minimum age for making a booking is 18 years. The contract is established upon our acceptance of your booking and receipt of the deposit payment. Subsequently, we will email you written confirmation and an invoice. If, for any reason, we cannot accept a booking, any funds received will be promptly refunded. Please be aware that once booked, most special ferry or Eurotunnel services are non-refundable and non-changeable. You will receive information about any additional restrictions associated with your fare at the time of booking.
PAYMENT
We secure your reservation by holding your deposit, which contributes towards the total cost of the tour. Unless specified otherwise, the deposit required to confirm a booking with us stands at £500. The remaining balance must be settled no later than twelve weeks before your tour departure date, or by the final payment due date indicated on your tour confirmation invoice and tour documentation. Failure to make the full payment within the specified period allows us to consider your tour as cancelled by you, and consequently, the cancellation charges detailed in the section ‘Cancellation By You’ will be applicable. In the case of credit card or debit card payments, we accept Visa and MasterCard, American Express, Diners Club, and other similar cards. Additionally, we offer the option of payments via cheque or direct bank transfer.
OUR TOUR PRICES
The price displayed, unless stated otherwise, represent the price for two individuals sharing a twin or double room, and a car. Detailed pricing information for single guests, or those guests wishing to share a room and bring two cars, is available by contacting us directly.
Unless stated otherwise on the tour itinerary, prices include Eurotunnel / ferry crossings, hotel accommodation, car parking, breakfast, evening meals, loan of a UHF personal radio and Sat Nav, tour information pack, and membership of a dedicated tour WhatsApp group.
Prices exclude lunches, drinks, fuel, Autoroute tolls, room service and any hotel extras, entry to places of interest, travel insurance for driver and passenger, and vehicle breakdown insurance.
We retain the right to inform you of any adjustments to the published price and any modifications to tour arrangements before confirming your booking.
Once your booking is confirmed and a deposit is paid, the price is fully confirmed and will not be subjected to any additional increases.
Single supplements are applicable for sole use of a room and a car. Occupying a single room does not guarantee allocation to a double or twin room. In some cases, a single room may be compact, featuring a single bed. Note: Some European hotels may offer twin rooms consisting of a large bed base with two single mattresses and separate bedding.
CANCELLATION BY YOU
In the event of failure to complete the full payment for the tour within the stipulated timeframe or should you decide to cancel your tour, you will be held accountable for the charges detailed below up to the cancellation point. In case of failure to pay the balance by the due date, we reserve the right to consider your booking as cancelled by you. All cancellations must be communicated in writing by the individual who made the initial booking. The cancellation charges will be calculated based on the date of receipt of the written cancellation notice or the date when your cancellation is treated as due to non-payment. The following cancellation charges may be applied, calculated as a percentage of the total tour cost stated on our invoice, excluding the specified items:
0 – 14 days before commencement of tour: 100% of total tour cost
15 – 30 days before commencement of tour: 70% of total tour cost
31 – 70 days before commencement of tour: 50% of total tour cost
More than 70 days before commencement of tour: Loss of deposit
Please note: Non-refundable ferry or Eurotunnel tickets will be charged at 100%, and the aforementioned cancellation charges will be applicable to the remaining tour cost. Insurance premiums and amendment charges are non-refundable. Additional accommodation costs for reduced occupancy or other components may be applicable if one or more passengers cancel, but the remaining passengers still wish to travel. In case your cancellation falls within the provisions of your travel insurance policy, you may be eligible to submit a claim directly to your insurance company. For Group Bookings, the stated cancellation charges will be applicable to all members of the group in the unlikely event of cancellation by the lead booking/passenger.
ALTERATIONS AND ADJUSTMENTS BY OTR CAR TOURS LTD
In organising our offered tours, significant planning occurs months in advance. Occasionally, adjustments and corrections must be made both pre-booking and post-confirmation. Events or activities that are confirmed may need to be cancelled. Tours venturing into remote regions of Europe carry the potential for parts of the tour to undergo alterations beyond our control, such as adverse weather conditions, sometimes on short notice. While we strive to minimise changes and cancellations, we reserve the right to make necessary adjustments.
Minimum Participant Requirement – Some of our tours necessitate a minimum number of cars and / or participants for operation. In cases where the minimum requirement has not been met, we hold the right to cancel the tour, provided we inform you at least eight weeks before departure. In such circumstances, we cannot be held liable for the costs associated with additional travel arrangements made in conjunction with the cancelled tour, unless these arrangements are booked through OTR Car Tours Ltd.
Route Adjustments – Navigation routes outlined in the provided tour itineraries, and programmed into Sat Nav devices and Apps, are regularly reviewed. However, we cannot be held responsible for changes in road conditions, such as emergency road closures, that may necessitate a deviation from the proposed route. In the event of such a change and when we are informed of it, we will strive to notify you and propose a suitable alternative.
Minor Revisions – Minor alterations encompass changes such as ferry company, Eurotunnel time adjustments of less than 12 hours, and modifications to supplementary arrangements like excursions or changes of accommodation to another of the same standard.
Significant Amendments – In cases where significant changes or cancellations to arrangements are imperative, we will communicate with you promptly. If time allows before departure, we will offer you the option to: 1) accept the modified arrangements, or 2) purchase an alternative tour from us of similar standard to the originally booked one, if available. Any cost difference in this alternative will be refunded if it’s lower than your original tour. Alternatively, you may choose 3) to cancel or accept the cancellation, in which case you’ll receive a full refund of all monies paid to us.
Cancellation – While rare, unforeseen ‘circumstances beyond our control’ may force us to modify or terminate your tour after departure but before its scheduled end. In such unlikely instances, we regret to inform that we cannot issue refunds, compensate, or cover any incurred costs or expenses. We don’t manage the daily operations of your accommodation, and in exceptional cases, we may receive advice that the reserved accommodation has been overbooked. If this occurs before your departure or upon arrival at the destination, we will strive to provide accommodation of at least the same standard in the same area. If only lower standard accommodation is available, we will refund the price difference. Additionally, we will compensate up to £50 per person for any inconvenience caused.
UNFORSEEN CIRCUMSTANCES
Unless explicitly stated otherwise in these booking conditions, we deeply regret that we cannot assume responsibility or provide compensation for any hindrance or inconvenience that arises due to circumstances beyond our control affecting our contractual obligations to you. In these terms and conditions, ‘circumstances beyond our control’ refers to any event that neither we nor the service supplier could have reasonably anticipated or prevented, even with the utmost diligence. Such events encompass actual or potential warfare, civil unrest, acts of terrorism and their repercussions (including suspected terrorist activities and all measures taken during any “terror alert”), labour disputes, natural or nuclear catastrophes, adverse weather conditions, outbreaks of diseases (including restrictions imposed by local or national authorities due to COVID or any other notifiable illnesses), unavoidable technical issues with transportation, fires, and other comparable events beyond our influence. This list is not exhaustive.
OWN ARRANGEMENTS
We cannot be held liable or responsible for any elements of your tour which are considered “own arrangements” i.e., not included in our tour package. We recommend that you ensure that you take out appropriate insurance to cover any such arrangements.
MODIFICATIONS REQUESTED BY YOU
Changes to your booking are subject to our approval and should be requested by the individual responsible for the booking. We retain the authority to impose an administration fee of £30 for each change, in addition to any supplementary booking expenses resulting from the modifications. This encompasses alterations in occupancy subsequent to a cancellation (see Section 4: Cancellation by You). Depending on the extent of the requested change and the impact on our operations, supplementary charges may apply. If, due to unavoidable circumstances, you are unable to embark on the tour, we may consider transferring your booking to an alternative person or group suggested by you. However, this transfer request must reach us at least 30 days prior to the departure date, accompanied by written proof justifying your inability to travel (such as a Doctor’s Certificate). You are required to furnish all original travel documents, the transferee’s complete name and address, and ensure that the transferee meets the tour requirements. Both the initial booking costs and the transfer-related charges, amounting to an administrative fee of £30 and any supplier-imposed costs, must be settled before the transfer can be finalised. For instance, ferry companies may demand 100% cancellation charges and the price of a new ticket for any alterations. If you decide to truncate your tour or shorten the duration of pre-booked accommodations (including reimbursements for uneaten meals, excursions, or other unused tour elements), we cannot provide refunds for the uncompleted portion of your trip or assist with any associated curtailment expenses. Depending on the circumstances, your travel insurance might cover curtailment costs, and we recommend pursuing any claims directly with them, following their policy stipulations.
REFUNDS POLICY
Normally, refunds will be administered using the original payment method used during the booking. The reimbursement will be issued to the individual who executed the initial payment. The duration for processing the refund varies based on the payment method. We strive to expedite all credit card refunds within 48 hours upon approval.
EXCEPTIONAL SITUATIONS
Our tours are not intended for individuals engaging in specialised projects, research activities, or any related endeavours, whether for educational, professional, or other purposes. We hold no responsibility for any losses or damages incurred as a result of such usage or planned activities, including those with significant financial implications. Please note: if you plan to utilise our tours for such intentions, it is essential to secure appropriate insurance coverage for both your activity and any specialised equipment you may choose to bring along.
PARTICIPATION CONDITIONS FOR TOUR
By participating in one of our tours, you hereby agree to abide by the authority and decisions made by our directors, team members, tour managers, and representatives, during the course of the tour. Should it be deemed by any of these individuals that your health or behaviour, before, during, or after departure, poses a potential risk to the safety, comfort, or smooth progress of the tour, you may be excluded from specific parts or the entirety of the tour. Additionally, we reserve the right to terminate your tour under such circumstances. Any extra costs incurred due to this exclusion will be your responsibility. In cases of health issues, we will make suitable arrangements and recover the resultant costs from you as necessary. Please note that we retain the right to refuse a booking in specific situations.
It is your responsibility to ensure you abide by all statutory laws and regulations of each of the countries the tour travels through. These include, without limitation to, your regard to driving laws including the legality of your vehicle (including road fund licence, insurance, and MOT), speed limits, and not driving under the influence of any intoxicating substances.
It is essential, should you wish to overtake another guest, that you use your radio to request and receive permission, before commencing the overtake.
You must hold a full valid driving license, and passport and visa if applicable.
You are strictly prohibited from engaging in any form of competition or racing with fellow guests or other individuals on the road. You bear full responsibility for your own conduct, and OTR Car Tours Ltd cannot be held accountable by you or any third party for any involvement in unlawful or antisocial activities. As such, you agree to indemnify OTR Car Tours Ltd completely against any attempts by third parties to initiate legal claims due to any violations of laws or regulations committed by you while participating in the tour.
You are not obligated to affix any livery to the outside of your vehicle, and you are prohibited from applying any number decals to its exterior. This action has the potential to, in numerous instances, nullify your insurance coverage, and draw unfavourable attention. If you decide to apply stickers to your automobile, please be aware that we retain the prerogative to demand their removal if we determine them to be inappropriate in any manner.
By taking part in a tour, you consent to the capture of photographs and cinematic footage that may include you and your belongings. You also grant OTR Car Tours Ltd permission to use these images for promotional purposes, including but not limited to its website, social media channels, printed media, and video, without imposing any fees or charges. While you retain the right to take your own photographs and videos, you are not authorised to represent these materials as endorsed by OTR Car Tours Ltd without our explicit consent.
If you do not agree to these terms, kindly inform us before participating in the tour. Please note that you cannot subsequently make any claims regarding privacy invasion or defamation.
HEALTH, VISA & NECESSARY DOCUMENTS
Each traveller must ensure they possess a valid passport, necessary visas (if applicable), all required inoculations, and health certificates for the countries to be visited. All associated costs are the individual’s responsibility. We recommend consulting your doctor well in advance of your departure. Your passport should remain valid for at least three months beyond your return to the UK.
While we will provide reasonable assistance and guidance on obtaining these documents, we cannot be held responsible if any party member is denied entry onto transportation or into any country.
If you or any member of your party is not a British Citizen or does not hold a British citizen’s passport, it is your responsibility to verify passport and visa requirements with the respective Embassy or Consulate of the countries on your travel itinerary. The European Health Insurance Card (EHIC) and its successor, the UK Global Health Insurance Card (GHIC), allow you to access state healthcare in Europe at a reduced cost or sometimes for free. EHICs and GHICs are valid throughout the European Economic Area (EEA) and Switzerland. However, please note that a GHIC or an existing EHIC cannot be used in Norway, Iceland, or Liechtenstein. OUR OBLIGATION
We diligently endeavour to ensure that the tour arrangements we’ve agreed to provide, as stipulated in our contract with you, are executed with a reasonable degree of skill and care. Our commitment involves overseeing and managing the performance of our service providers, evaluating their performance against the relevant standards and practices of the country where the services are rendered. In compliance with these booking conditions, we accept responsibility in circumstances such as when you suffer a loss of life, personal injury, or if the tour arrangements outlined in your contract are not fulfilled as promised or fall short due to the failure of ourselves, our staff, agents, or service providers to exercise reasonable skill and care in organising, performing, or delivering, as applicable, your contracted tour arrangements.
It’s important to note that you bear the responsibility of demonstrating that reasonable skill and care were not applied should you intend to file a claim against us. Furthermore, we will only be held accountable for the actions or inactions of our staff, agents, and suppliers if they were acting within the scope of their employment (for employees) or carrying out tasks assigned by us (for agents and suppliers) at the time. We absolve ourselves of liability for any injury, illness, loss of life, loss of enjoyment, damage, expense, cost, or any other claim or sum arising from:
1) Actions or omissions of the individuals affected or any member of their party.
2) Actions or omissions of a third party unrelated to the provision of your tour, unforeseeable, or unavoidable.
3) ‘Circumstances beyond our control’ as defined in the section ‘Unforeseen Circumstances’.
Please note, we cannot be held accountable for any services not encompassed within our contract. This includes additional services like excursions or amenities that your hotel or any other supplier agrees to provide, where these services or facilities are not advertised by us, and we haven’t agreed to arrange them as part of our contract. Additionally, we disclaim liability for any damage, loss, expense, or other sums under the following circumstances:
4) That, based on the information provided by you regarding your booking before our acceptance, we could not have predicted or anticipated you would suffer or incur if we breached our contract with you.
5) That did not result from any breach of contract or fault on our part or our employees or, where we are accountable, our suppliers.
6) That arises from the use of our services for special projects or research, be it for study, employment, or otherwise.
7) That is related to any business.
For all claims not related to death, personal injury, or loss or damage of personal belongings (see below), if we are found liable to you on any grounds, the maximum amount we’ll be liable to pay is twice the amount paid for your tour (excluding amendment charges) by or on behalf of the affected individual(s) in total. This maximum amount will be payable only in instances where your tour has failed entirely, and you’ve received no benefit whatsoever from your tour. Nothing in these booking conditions shall exclude or limit our liability for fraud, or for death, or personal injury caused by our negligence or the negligence of our employees.
Excursions – We present opportunities to partake in excursions and activities (“excursions”). These excursions can be booked as part of your inclusive tour package or separately (with or without booking any other travel arrangements). In most cases, we act as an intermediary for the sale of these excursions. For all bookings of these excursions (except as specified below), you will enter into a contract with the Excursion Organiser, not with us, and we bear no liability for the excursions or for the actions or omissions of the Excursion Organiser or any of its employees, agents, suppliers, or subcontractors. The terms and conditions of the Excursion Organiser (and not these booking conditions) shall apply, as displayed during the booking process. If any of the excursions are booked and paid for directly with us, forming part of an inclusive tour package, our booking conditions will apply to the excursion, and it will be considered a part of your contract with us. The liability of the Excursion Organiser to you will be subject to the conditions stipulated by them.
CAR PARKING
We strive to arrange accommodations with complimentary secure on-site car parking. While we make every effort to secure such parking, there might be instances where the parking facility is not managed by the hotel, and local parking charges may apply. We make requests to hotels to reserve parking for our clients whenever possible. However, we cannot guarantee this and, in the event that hotel parking reaches full capacity, we cannot be held accountable for any resulting costs. Some hotels provide secure underground car parking; nevertheless, this may not be suitable for vehicles with excessive height or low ground clearance. It remains the driver’s responsibility to assess if their vehicle can safely access and exit these facilities without causing damage either to their car or the parking structure. We disclaim liability for any vehicle damage that may occur.
TRAVEL INTERRUPTION
In the event of delays caused by adverse weather conditions disrupting your travel plans, there may be additional expenses incurred, and these will be the responsibility of you, the client. Regrettably, we are unable to provide assistance in case of delays at your starting or return travel point. However, the ferry operator or Eurotunnel will assist you in line with their respective delay policies. We cannot be held liable for delays attributed to factors outlined in Section 6 of these booking conditions (which encompass actions of any passenger(s) during the ferry or Eurotunnel crossing, such as failure to adhere to check-in or boarding timings). In instances where prolonged delays result in lost tour time, we are unable to provide refunds for unused accommodation or other services, as our suppliers do not authorise reimbursements under such circumstances. Hotel rooms are reserved for delayed arrivals and are not re-allocated. We highly recommend ensuring you possess appropriate and comprehensive insurance coverage to adequately safeguard against such unforeseen circumstances.
TRAIN & SEA CARRIERS
The responsibilities of train and sea carriers are regulated by the following amended or unamended conventions and regulations: the Athens Convention for sea travel, the Berne Convention for rail travel, and the Geneva Convention for road travel. Train travel and Sea travel Conditions of Carriage are established by train and sea carriers and are an integral part of the contract between you and us, as well as between you and the respective train and sea carriers. These conditions can be obtained from the carrier directly or from us, along with copies of relevant international conventions and regulations. When booking your tour, you are bound by these conditions.
Specific obligations regarding missing or damaged baggage claims, as outlined on your ticket or the Conditions of Carriage, must be followed. If any claim against us, including those concerning death or personal injury, is related to travel arrangements provided by, sea, rail, or road carriers (including embarkation and disembarkation processes), the compensation we are liable to pay is limited. The maximum amount we will pay for such a claim is governed by the applicable international convention or regulation (as indicated above), reflecting what the carrier concerned would be required to pay.
It’s important to note that if a carrier or hotelier is not obliged to make any payment to you under the applicable international convention or regulation for a particular claim, we are similarly not obligated to make a payment for that claim. During any payment process, we reserve the right to deduct any amount you have received or are entitled to receive from the carrier for the complaint or claim in question.
At the time of booking, we may not always be able to confirm the ferry or train timings associated with your primary ferry or train journey. The timings provided on our website, or detailed on your tour confirmation invoice are indicative and subject to change. These timings are beyond our control and are determined by the respective ferry companies or Eurotunnel, influenced by factors such as weather conditions, technical issues, and passengers’ ability to check in on time. Detailed instructions regarding departure and travel arrangements will be dispatched with your ferry, air, or other travel tickets approximately 2 weeks before departure. Upon receiving your tickets, please carefully verify the ferry or flight times to ensure their accuracy and timeliness. Changes in carrier identity, ferry or flight timings, or vessel/aircraft type will not entitle you to cancel or alter the arrangements without paying our standard charges, except as specified in these conditions.
INSURANCE
The expenses related to medical treatment abroad, breakdown assistance, repatriation for both yourself and your vehicle can escalate significantly. We want to emphasise that we cannot bear any responsibility for covering these expenses. Hence, as a crucial stipulation for booking with us, we insist that you secure comprehensive insurance coverage.
It is your responsibility to ensure you have the appropriate travel insurance in place for yourself, passengers in your vehicle, luggage, and the vehicle itself. We also require you to have the appropriate level of breakdown cover in place for your vehicle for those countries in which we are travelling. We also recommend that you and your passengers apply for a free Global Health Insurance Card (GHIC) or European Health Insurance Card (EHIC). Whilst GHIC and EHIC do not replace travel insurance, the card helps you obtain state healthcare in Europe at a reduced cost or sometimes for free. SPECIAL REQUESTS, MEDICAL CONDITIONS AND DISABILITIES
In case you have any specific requests, please inform us during the booking process. While we will make every effort to communicate reasonable requests to the appropriate supplier, we cannot guarantee that they will be fulfilled. Our inability to meet a particular request does not constitute a breach of our agreement. Please note that the acknowledgment or transmission of a special request to the supplier, or its inclusion in your confirmation invoice or any other documentation, does not assure its fulfilment. Until confirmation is explicitly provided, all special requests are subject to availability. For your assurance, we recommend obtaining written confirmation for any crucial requests. Unfortunately, we cannot accept bookings contingent on the fulfilment of a specific request; such bookings will be treated as standard, adhering to the terms outlined regarding special requests.
If you or any member of your party has a medical condition, disability, or special requirements due to a medical condition or disability that may impact your tour, kindly inform us before confirming your booking. This allows us to assist you in evaluating the suitability of the arrangements and facilitating the booking process. Please ensure to provide comprehensive written details of any medical condition or disability at the time of booking and promptly update us if any changes occur thereafter.
COMPLAINTS
Should you have any reason to express dissatisfaction regarding any aspect of your tour, we kindly request you to initially address the concern with the responsible person overseeing the relevant service at the location. If this isn’t feasible, please get in touch with our local representative (if applicable) or contact our UK office using the provided number in your travel documents. This step is crucial to allow us to promptly rectify any issues wherever possible. Neglecting to follow this procedure may impact any claim for compensation. If an issue remains unresolved during your tour, it’s important to submit a written complaint to OTR Car Tours Ltd within 28 days from the conclusion of your tour. We will respond to you within 28 days of receiving your letter, following our established code of conduct. In the event that, despite our diligent efforts and adherence to the aforementioned complaint reporting and resolution process, you still find the resolution unsatisfactory, we recommend referring the matter for arbitration through the ABTOT Travel Industry Arbitration Service.
USE OF PERSONAL INFORMATION
We comply with the UK Data Protection Act 2018 and General Data Protection Regulations. Your personal information, including sensitive data, has been furnished to us to facilitate the following purposes: reserving your spot; documenting and providing you with a ticket, itinerary, confirmation invoice, and any additional documents linked to your tour; notifying you of any modifications to your itinerary; addressing your inquiries or requests; generating receipts; delivering your tour experience; offering supplementary services connected to your tour; managing accounting, billing, and auditing processes, as well as other administrative tasks; ensuring security compliance; identifying and preventing criminal activities; managing customer relations matters; analysing statistical data; aiding us in future transactions with you; conducting system tests; performing market analysis; customising our marketing efforts to suit your specific tour requirements; conducting benchmarking and performance evaluations; maintaining or enhancing our IT systems; fulfilling legal obligations towards you; sharing data with government agencies in relation to your tour (such as security, customs, or immigration, as mandated by applicable law); sharing data with necessary third parties in case of an emergency; and any other purposes associated with or incidental to your tour.
